1.1 Definitions
Account
The trading account opened with us for the purpose of trading Forex Futures.
Applicable Regulations
All laws, regulations, directives applicable to Forex Futures trading in relevant jurisdictions.
Base Currency
The first currency in a currency pair quotation.
Counter Currency
The second currency in a currency pair quotation.
Forex Futures
Standardized contracts to buy or sell a specific currency at a predetermined price on a set future date.
Initial Margin
The minimum amount of funds required to open a leveraged position.
Maintenance Margin
The minimum account balance required to keep positions open.
Margin Call
A demand for additional funds to maintain open positions.
Pip
The smallest price move that a given exchange rate can make.
Spread
The difference between the bid and ask price.
Stop-Loss
An order to close a position at a predetermined price to limit losses.
Take-Profit
An order to close a position at a predetermined price to secure profits.
1.2 Interpretation
- References to "we," "us," "our," or the "Company" refer to ForexFutures Investment.
- References to "you," "your," or the "Client" refer to the account holder.
- Headings are for convenience only and do not affect interpretation.
- Singular includes plural and vice versa where context permits.

SECTION 02
Eligibility & Account Opening
2.1 Eligibility Requirements
By opening an Account, you represent and warrant that you:
- Are at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is higher).
- Have the legal capacity to enter into binding contracts.
- Are not a citizen or resident of jurisdictions where Forex Futures trading is prohibited or restricted.
- Are not a politically exposed person (PEP) or subject to international sanctions.
- Are opening the Account for your own benefit and not on behalf of any third party.
- Have provided accurate, complete, and truthful information during the application process.
- Have read, understood, and agree to be bound by these Terms and all referenced policies.
2.2 Account Application
You must complete our standard application form and provide all requested documentation, including:
- Government-issued photo identification.
- Proof of residential address (dated within the last 3 months).
- Financial information and investment experience questionnaire.
- Source of funds declaration.
- Tax identification number (where applicable).
Note: We reserve the right to reject any application at our sole discretion without providing reasons. You agree to notify us immediately of any changes to information provided.
2.3 Verification & KYC
- We are required by law to verify your identity and assess your suitability for Forex Futures trading.
- You consent to us conducting background checks, credit checks, and sanctions screening.
- We may request additional documentation at any time to comply with regulatory requirements.
- Account functionality may be restricted pending completion of verification.

Risk Acknowledgment & Suitability
3.1 High-Risk Nature of Forex Futures
⚠ RISK DISCLOSURE — READ CAREFULLY
- Forex Futures trading involves substantial risk of loss and is not suitable for all investors.
- Leverage amplifies both potential gains and potential losses.
- You may lose more than your initial investment and be required to deposit additional funds.
- Past performance is not indicative of future results.
- Market conditions can change rapidly and unpredictably.
- Forex markets operate 24 hours a day; positions may be affected by events outside normal business hours.
3.2 Suitability Assessment
- We will assess your knowledge, experience, financial situation, and investment objectives to determine whether Forex Futures trading is appropriate for you.
- We may restrict certain products, leverage levels, or trading features based on this assessment.
- You must promptly inform us of any material changes to your financial situation or investment objectives.
3.3 Independent Decision Making
You acknowledge that all trading decisions are made solely by you. We do not provide investment advice, recommendations, or tax advice. Any market commentary, research, or analysis provided is for informational purposes only and does not constitute advice.

Trading Terms & Conditions
4.1 Order Execution
- All orders are subject to our Order Execution Policy.
- We act as principal or agent as disclosed in our execution arrangements.
- While we endeavor to execute orders at requested prices, execution prices may vary due to market volatility and liquidity.
- We may decline to execute orders or execute at different prices in certain market conditions.
- Orders may be executed in partial fills.
4.2 Types of Orders
Market Orders
Executed at the best available price at the time of execution.
Limit Orders
Executed at the specified price or better.
Stop Orders
Become market orders when the stop price is reached. Execution at the stop price is not guaranteed.
Stop-Loss / Take-Profit
Subject to slippage and market gaps; execution at specified price is not guaranteed.
4.3 Market Hours & Sessions
- Forex Futures trading hours are determined by the relevant exchange(s).
- Orders placed outside trading hours will be processed when the market reopens.
- Market holidays and exchange closures may affect trading availability.
4.4 Price Quotes & Spreads
- Prices are derived from liquidity providers, exchanges, and market data feeds.
- Spreads may widen during periods of low liquidity or high volatility.
- We reserve the right to adjust spreads in exceptional market conditions.
- Prices displayed are indicative and subject to confirmation at execution.

Margin Requirements & Leverage
5.1 Margin Requirements
- You must maintain the Initial Margin and Maintenance Margin as specified by us or the relevant exchange.
- Margin requirements may be changed at any time without prior notice, including during periods of high volatility.
- Margin requirements are calculated in real-time and displayed on your trading platform.
5.2 Margin Calls
- You will receive a Margin Call when your account equity falls below the Maintenance Margin requirement.
- Margin Calls may be delivered via email, SMS, platform notification, or telephone.
- You are responsible for monitoring your account and maintaining adequate margin at all times, regardless of whether you receive a Margin Call.
5.3 Stop-Out & Liquidation
⚠ LIQUIDATION NOTICE
- If account equity falls below the Stop-Out level, we may, without notice, close some or all open positions.
- Pending orders may be cancelled and further trading restricted until additional funds are deposited.
- Stop-Out is executed at market prices, which may result in significant losses.
- You remain liable for any negative balance resulting from liquidation.
5.4 Negative Balance Protection
Where applicable, we provide negative balance protection meaning you cannot lose more than your account balance under normal market conditions. This protection does not apply during exceptional market conditions such as flash crashes or market gaps.
5.5 Leverage Limits
- Maximum leverage is determined by regulatory requirements and our risk assessment.
- We may reduce leverage limits at any time based on market conditions, your trading activity, or regulatory requirements.
- You may request lower leverage limits, which we will implement within the specified timeframe.

Deposits & Withdrawals
6.1 Funding Your Account
- Deposits must be made from accounts or payment methods registered in your name.
- Third-party deposits are strictly prohibited and will be returned.
- We accept deposits via Bank Transfer, Credit/Debit Card, and approved Electronic Wallets.
- Deposits may be subject to processing fees as disclosed in our Fee Schedule.
6.2 Withdrawals
- Withdrawal requests must be submitted through your secure client portal.
- Withdrawals will be processed to the original deposit method or to a verified bank account in your name.
- We may require additional verification before processing large withdrawals.
- Withdrawals are subject to our Anti-Money Laundering (AML) procedures.
6.3 Fees & Charges
- A detailed schedule of fees, commissions, spreads, financing charges, and other costs is available on our website.
- You are responsible for all fees charged by banks, payment processors, or intermediaries.
- We may charge inactivity fees for dormant accounts as specified in our Fee Schedule.
- All fees are deducted from your account balance.
6.4 Currency Conversion
- If your account currency differs from the deposit/withdrawal currency, conversion will be at our prevailing exchange rates.
- Currency conversion fees may apply as disclosed in our Fee Schedule.

Fees, Commissions & Financing
7.1 Trading Costs
Commissions
Charged per lot/contract traded as specified in our Fee Schedule.
Spreads
Bid/ask difference varying by currency pair and market conditions.
Exchange Fees
Pass-through fees charged by relevant exchanges.
Clearing Fees
Fees for clearing and settlement services.
7.2 Overnight Financing (Swap/Rollover)
- Positions held open past the daily rollover time incur financing charges or credits.
- Financing rates are based on interbank rates plus/minus our markup.
- Financing is calculated on the full notional value of the position, including leveraged portions.
- Financing rates are displayed on the trading platform and may change daily.
7.3 Fee Changes
- We may modify fees and charges with adequate advance notice, except where changes are required by regulatory action or market conditions, in which case changes may be immediate.
- Continued use of our services after fee changes constitutes acceptance.

Client Money & Asset Protection
8.1 Segregation of Client Funds
- All client funds are held in segregated bank accounts separate from our own funds.
- Client funds are not used for our business operations or to hedge our own positions.
- In the event of our insolvency, segregated client funds are protected in accordance with Applicable Regulations.
8.2 Compensation Schemes
Where applicable, we are a member of a recognized compensation scheme that provides protection per eligible client. Compensation scheme protection does not cover trading losses.
8.3 No Interest on Account Balances
- Unless otherwise agreed, we do not pay interest on account balances.
- Interest may be paid on cash balances above specified thresholds at agreed rates where applicable.

Trading Platform & Technology
9.1 Platform Access
- We provide access to trading platforms subject to these Terms and any platform-specific terms.
- You are responsible for maintaining the security of your login credentials.
- You must not share your account credentials with any third party.
- You must notify us immediately of any unauthorized access or security breach.
9.2 System Availability
- We endeavor to maintain platform availability but do not guarantee uninterrupted access.
- Platforms may be unavailable due to maintenance, technical issues, or circumstances beyond our control.
- We are not liable for losses resulting from platform unavailability, except in cases of gross negligence or willful misconduct.
9.3 Data & Connectivity
- You are responsible for maintaining adequate internet connectivity and hardware.
- We are not liable for losses resulting from delays in data transmission, internet outages, or equipment failure on your end.
9.4 Automated Trading
- Use of Expert Advisors (EAs), algorithms, and automated trading systems is permitted subject to our Automated Trading Policy.
- You are solely responsible for the performance and risk management of automated systems.
- We reserve the right to restrict or terminate automated trading that disrupts our systems or violates fair usage policies.

Prohibited Activities & Market Abuse
10.1 Prohibited Conduct

- Market manipulation, including wash trading, spoofing, layering, or quote stuffing.
- Insider trading or trading on material non-public information.
- Front-running or latency arbitrage that exploits technological advantages unfairly.
- Abusive trading strategies including scalping, hedging across multiple accounts, or bonus arbitrage (where prohibited).
- Money laundering, terrorist financing, or other financial crimes.
- Any activity that violates Applicable Regulations or these Terms.
10.2 Consequences of Prohibited Activities
- We may, without notice, cancel trades deemed abusive or manipulative.
- Positions may be closed and your Account terminated.
- Suspicious activity will be reported to regulatory authorities.
- Profits from prohibited activities may be seized and legal action pursued.
- You indemnify us against all losses and liabilities arising from your prohibited activities.

Intellectual Property
11.1 Ownership
- All intellectual property rights in our trading platforms, websites, logos, trademarks, and content are owned by us or our licensors.
- You are granted a limited, non-exclusive, non-transferable license to use our platforms for trading purposes only.

- You may not reverse engineer, decompile, or disassemble our software.
- You may not copy, modify, distribute, or create derivative works from our content.

12.3 Marketing Communications
- You may opt out of marketing communications at any time.
- Essential service communications (e.g., margin calls, account statements) cannot be opted out of.

Liability & Indemnification
13.1 Limitation of Liability
To the maximum extent permitted by law, we are not liable for:
- Indirect, consequential, special, or punitive damages.
- Loss of profits, revenue, or business opportunities.
- Losses resulting from market conditions, force majeure, or third-party actions.
- Losses resulting from your failure to act on Margin Calls or monitor your account.
13.2 Exclusions
Nothing in these Terms excludes or limits liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded under Applicable Regulations.
13.3 Indemnification
You agree to indemnify and hold us harmless from all claims, losses, damages, and expenses arising from:
- Your breach of these Terms.
- Your trading activities.
- Your violation of Applicable Regulations.
- Any misrepresentation made by you.

SECTION 14
Force Majeure
14.1 Events
We are not liable for failure to perform obligations due to events beyond our reasonable control, including:
- Natural disasters, acts of God, war, terrorism, riots, or civil unrest.
- Government actions, regulatory changes, or exchange closures.
- Technical failures, cyberattacks, or internet disruptions.
- Failure of third-party service providers, liquidity providers, or exchanges.
- Market disruptions, trading halts, or extreme volatility.
14.2 Actions During Force Majeure
- During force majeure events, we may suspend trading or platform access.
- Positions may be closed at prevailing prices and margin requirements adjusted.
- We may take any action deemed necessary to protect our interests and those of our clients.

Termination & Account Closure
15.1 Termination by You
- You may close your Account at any time by providing written notice.
- You must close all open positions and settle all outstanding obligations before Account closure.
- We will process remaining balances within the specified timeframe after closure, subject to verification.
15.2 Termination by Us
We may terminate or suspend your Account immediately if:
- You breach these Terms or Applicable Regulations.
- You engage in prohibited activities.
- You provide false or misleading information.
- You fail to respond to Margin Calls or maintain required margin.
- We are required to do so by regulatory authority or we discontinue services in your jurisdiction.
15.3 Effects of Termination
- Termination does not affect accrued rights and obligations.
- You remain liable for any negative balance or outstanding fees.
- We may retain records as required by law.

Complaints & Dispute Resolution
16.1 Complaints Procedure
- Complaints must be submitted in writing to our designated complaints department.
- We will acknowledge receipt within the stated timeframe and provide a final response within the regulatory deadline.
- If dissatisfied with our response, you may escalate to the relevant ombudsman or regulatory body.
16.2 Dispute Resolution
- These Terms are governed by the laws of the specified jurisdiction.
- Any dispute shall be resolved through binding arbitration, mediation, or submission to the courts of the relevant jurisdiction.
- You waive any right to participate in class actions against us.
16.3 Regulatory Recourse
Nothing in these Terms restricts your right to complain to or seek redress from relevant regulatory authorities.

General Provisions
17.1 Entire Agreement

- Material changes affecting your rights will be notified via email or platform notification.
- Continued use of our services constitutes acceptance of any amended Terms.
17.3 Severability & Waiver
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
- No waiver of any right under these Terms shall be effective unless in writing.
17.4 Assignment
- We may assign our rights and obligations under these Terms without your consent.
- You may not assign or transfer your rights or obligations without our prior written consent.
